GearCache Terms of Use

These Terms of Use (“Terms”) govern your use of the GearCache app and the gearcache.app website (collectively, “the Service”). By downloading, installing, or using GearCache, you agree to these Terms.

Version 1.0 scope: GearCache ships as a free, local-only inventory and trip-checklist app on iPhone and Android. There are no user accounts, no in-app purchases, no subscriptions, and no GearCache backend that stores your data. These Terms describe a deliberately small surface area; future versions may introduce additional features and these Terms will be updated accordingly before any such features go live.

1. Acceptance of Terms#

If you do not agree to these Terms, do not use the Service. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Description of Service#

GearCache is a personal inventory and trip-checklist application for iPhone and Android. The app is free and runs entirely on your device. No account is required, no account creation is offered, and the Service in this version does not transmit your inventory data off-device.

The gearcache.app marketing website provides product information, support resources, and an optional newsletter signup.

3. User Content#

You retain ownership of all content you create in GearCache, including inventory items, photos, categories, locations, tags, checklists, action lists, and notes (“User Content”).

In version 1.0, User Content stays on your device. We do not receive, store, transmit, or process your User Content on any GearCache server. We do not use it for advertising, analytics, training, or any other purpose, because we never have access to it.

4. Acceptable Use#

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws.
• Reverse-engineer, decompile, or attempt to extract the source code of the app, except to the extent expressly permitted by applicable law.
• Use the Service to store or transmit malicious code, spam, or infringing content.
• Interfere with or disrupt the Service or the servers and networks that host the gearcache.app website.
• Resell, sublicense, or otherwise commercially exploit the Service without our written permission.

5. Intellectual Property#

The GearCache name, logo, app, website, and all associated content (excluding User Content) are the property of GearCache and its licensors. These Terms do not grant you any rights to use our trademarks, logos, or branding without prior written consent.

6. Privacy#

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The short version: in version 1.0, the app collects nothing from your device, and the website’s footprint is limited to privacy-respecting page-view analytics and the optional newsletter.

7. Disclaimer of Warranties#

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses. You use the Service at your own risk.

GearCache is a tool to help you organise inventory and prepare for trips. You are responsible for verifying your own packing lists and preparedness — we are not liable for items forgotten, misplaced, lost, or damaged during trips.

8. Limitation of Liability#

To the maximum extent permitted by law, GearCache and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve months preceding the claim, or (b) AUD $100.

9. Termination#

You may stop using the Service at any time by uninstalling the app. Because version 1.0 does not create user accounts or transmit data to a GearCache server, there is nothing else you need to do — uninstalling removes the app and its data from your device.

We may withdraw or suspend the Service, in whole or in part, at any time. Upon termination, your licence to use the Service ends, but any data stored locally on your device remains under your control.

10. Changes to the Service and Terms#

We may modify or discontinue the Service, or any feature of the Service, at any time. We may update these Terms from time to time; material changes will be announced via the app or the website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

If a future version of GearCache introduces features that materially change the relationship described here — for example, optional account creation, data sync, or paid features — we will update these Terms before turning those features on.

11. Governing Law#

These Terms are governed by the laws of Australia. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
